By registering to bid, you acknowledge that you have read, understood, and agree to be bound by these Auction Terms & Conditions. All bids placed constitute a legally binding contract to purchase if you are the successful high bidder.

Welcome to Empire Auction Co. LLC! We appreciate your participation in our auction and are committed to providing an honest, transparent, and enjoyable bidding experience. We strive to accurately photograph and describe every item we sell while treating every bidder fairly and professionally. By registering for and participating in this auction, you acknowledge that you have read, understood, and agree to the following Terms & Conditions.

Auction Format

  • This is an online-only auction hosted by Empire Auction Co. LLC.
  • The auction features a soft close, with three (3) lots beginning to close each minute starting at the published closing time.
  • If a bid is placed within the final 60 seconds of a lot, that lot will automatically extend by an additional 60 seconds. Bidding will continue until no further bids are received.
  • We encourage bidders to utilize the Maximum Bid feature to ensure they do not miss an opportunity due to internet delays or being away from their device.

Registration & Bidding

  • A valid credit card is required to register for this auction.
  • By placing a bid, you are entering into a legally binding contract to purchase the item if you are the successful high bidder.
  • Bidders are responsible for carefully reviewing all descriptions and photographs before placing a bid.
  • Empire Auction Co. LLC reserves the right to approve, refuse, suspend, revoke, or terminate bidding privileges at its sole discretion.

Buyer's Premium, Sales Tax & Payment

  • A 10% Buyer's Premium will be added to the final bid price of all items.
  • Iowa sales tax of 7% will be collected where required by law unless a valid tax exemption certificate is provided prior to payment.
  • Firearms have a $10 Transfer Fee
  • Credit card payments are subject to a 3.5% convenience fee.
  • Buyers requesting shipment must submit online payment within 48 hours of receiving invoice after auction close unless prior arrangements have been approved by Empire Auction Co. LLC.
  • Local pickup customers may pay by cash, check, or online by credit card. Credit card payments must be completed online within 48 hours of auction close.
  • If payment is not received as required, Empire Auction Co. LLC reserves the right to charge the payment method on file.
  • Returned checks are subject to a $35 returned check fee. Issuing a worthless check for the purchase of a firearm may constitute a criminal offense and may be referred to the appropriate law enforcement authorities.

All items for this auction will be picked up at:

Business hours are Tuesday-Friday 9am-5pm, Saturday-Sunday 9am-3pm, Monday Closed.

  • Items must be picked up within ten (10) days following auction close unless prior arrangements have been approved.
  • Please schedule an appointment to avoid long wait times. 
  • Items remaining unclaimed after thirty (30) days may be considered abandoned and become the property of Empire Auction Co. LLC without refund.

Firearms

All firearm transfers will be completed through Highland Arms LLC, a federally licensed firearms dealer (FFL).

  • ALL FIREARMS HAVE A $10 TRANSFER FEE (to be paid on invoice to Empire Auction Co.)
  • All applicable federal, state, and local firearm laws apply.
  • A completed ATF Form 4473 is required for all applicable firearms picked up at Highland Arms LLC.
  • A National Instant Criminal Background Check System (NICS) background check will be conducted unless a qualifying Iowa Permit to Carry allows transfer in lieu of the background check.
  • Buyers requesting shipment must have firearms shipped to a federally licensed firearms dealer (FFL) of their choice.
  • Please email a signed copy of your receiving FFL license to garett@empireauctionco.com and include your invoice number and full name.
  • Buyers are solely responsible for ensuring that any firearm purchased is legal to own, possess, and receive under all applicable federal, state, and local laws.
  • Buyers must be at least eighteen (18) years of age to purchase rifles, shotguns, or rifle/shotgun ammunition, and at least twenty-one (21) years of age to purchase handguns, receivers, frames, or handgun ammunition, or otherwise comply with all applicable laws.
  • Failure to pass the required background check, failure to provide a valid receiving FFL, or inability to legally receive a firearm does not cancel the sale. In such cases, the purchaser forfeits all monies paid, including the Buyer's Premium, and the firearm may be resold by Empire Auction Co. LLC without further obligation to the purchaser.
  • Empire Auction Co. LLC reserves the right to cancel any firearm transaction that cannot legally be completed.

Shipping

Shipping is available on eligible items.

Firearms:

  • $25 per firearm

Ammunition:

  • $15 per lot (up to 15 lbs.)
  • Lots (or groups of lots if purchasing several) exceeding 15 lbs. will be billed at actual carrier cost.
  • Ammunition must ship separately from firearms.
  • Oversized items are eligible for shipping, and will be billed at actual freight costs. (this can get very expensive, please bid accordingly)
  • Shipping charges will be added to the buyer's invoice or invoiced seperately.
  • Empire Auction Co. LLC reserves the right to determine the appropriate carrier, service level, packaging, signature requirements, and insurance coverage for all shipments.
  • Empire Auction Co. LLC is not responsible for carrier delays or circumstances beyond its control but will reasonably assist buyers with carrier claims when appropriate.

Item Condition

Every reasonable effort has been made to accurately photograph and describe each item.

ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS, AND WITHOUT ANY WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED.

Descriptions, photographs, measurements, manufacturer information, and condition statements represent the opinion of Empire Auction Co. LLC and are provided solely as a guide. Variations in lighting, photography, monitor settings, manufacturer specifications, or normal wear may affect appearance.

We encourage all bidders to carefully review all photographs and descriptions before placing a bid.

If you believe an item has been materially misrepresented, you must notify Empire Auction Co. LLC within three (3) business days of pickup or delivery.

A material misrepresentation is a significant error in the listing that would have reasonably affected a bidder's decision to bid or the amount they were willing to bid.

Empire Auction Co. LLC stands behind its descriptions and will work in good faith to resolve legitimate listing errors. This policy does not apply to buyer's remorse, differences of opinion regarding cosmetic condition, normal wear, or conditions that were visible in photographs or disclosed in the listing.

Default

Failure to pay for purchased items constitutes a breach of these Terms & Conditions.

Empire Auction Co. LLC reserves the right to:

  • Charge the payment method on file.
  • Cancel the sale.
  • Revoke current and future bidding privileges.
  • Resell the item(s).
  • Pursue any legal remedies available to recover losses resulting from non-payment.

Additional Terms

  • Empire Auction Co. LLC reserves the right to correct catalog errors, modify descriptions, withdraw lots, postpone closing, or cancel sales when necessary.
  • Empire Auction Co. LLC is not responsible for internet interruptions, software failures, power outages, or technical issues experienced by bidders.
  • By participating in this auction, bidders consent to receive auction-related emails, invoices, payment reminders, pickup notifications, and promotional communications from Empire Auction Co. LLC. Promotional communications may be unsubscribed from at any time.
  • These Terms & Conditions shall be governed by the laws of the State of Iowa.
