By registering to bid, you acknowledge that you have read, understood, and agree to be bound by these Auction Terms & Conditions. All bids placed constitute a legally binding contract to purchase if you are the successful high bidder.

Welcome to Empire Auction Co. LLC. We appreciate your participation and are committed to providing an honest, transparent, and enjoyable bidding experience. We strive to accurately photograph and describe every item while treating every bidder fairly and professionally.

AUCTION FORMAT

  • This is an online-only auction hosted by Empire Auction Co. LLC.
  • This auction features a soft close, with three (3) lots beginning to close each minute starting at the published closing time.
  • If a bid is placed within the final 60 seconds of a lot, that lot will automatically extend by an additional 60 seconds.
  • Bidding on an extended lot will continue until no further bids are received during the extension period.
  • We encourage bidders to utilize the Maximum Bid feature to help avoid missing an opportunity due to internet delays or being away from their device.

REGISTRATION & BIDDING

  • A valid credit card is required to register for this auction.
  • By placing a bid, you are entering into a legally binding contract to purchase the item if you are the successful high bidder.
  • Bidders are responsible for reviewing their bids before submission. Bids are binding once placed and may not be retracted or reduced without the approval of Empire Auction Co. LLC.
  • Bidders are responsible for carefully reviewing all lot descriptions and photographs before bidding.
  • Empire Auction Co. LLC reserves the right to approve, refuse, suspend, revoke, or terminate bidding privileges at its sole discretion.

BUYER'S PREMIUM, SALES TAX & FEES

  • A 10% Buyer's Premium will be added to the final bid price of all items.
  • Iowa sales tax of 7% will be collected where required by law unless a valid tax exemption certificate is provided prior to payment.
  • All firearms are subject to a $10 firearm transfer fee, which will be included on the Empire Auction Co. invoice.
  • The $10 firearm transfer fee covers the transfer service provided on Empire's side of the transaction. Any transfer or other fees charged by an out-of-area buyer's receiving FFL are the responsibility of the buyer.
  • Online credit card payments are subject to a 3.5% convenience fee.

PAYMENT

Online Credit Card Payment

  • Credit card payments are accepted online only. Credit cards will not be accepted or processed at the pickup location.
  • Credit card payment is due within 48 hours after receipt of the finalized invoice, unless prior arrangements have been approved by Empire Auction Co. LLC.
  • Buyers requesting shipment should not pay their preliminary invoice until applicable shipping charges have been added and a finalized invoice has been received.

Cash or Check at Pickup

  • Cash and check payments are accepted in person at pickup only.
  • Checks must be made payable to Empire Auction Co. LLC.
  • Buyers planning to pay by cash or check at pickup do not need to pay their invoice online.
  • A paid receipt will be provided or emailed after payment is received.

Local Pickup – Previously Paid Online

  • Local pickup buyers may choose to pay their finalized invoice online by credit card.
  • Buyers who have already paid online should bring a copy of their paid invoice when picking up their items.

Non-Payment

  • If payment is not received as required, Empire Auction Co. LLC reserves the right to charge the payment method on file and exercise any other remedies provided within these Terms.
  • Returned checks are subject to a $35 returned check fee.
  • Issuing a worthless check for the purchase of a firearm may constitute a criminal offense and may be referred to the appropriate law enforcement authorities.

SHIPPING

Shipping is available on eligible items.

Requesting Shipping

Buyers requesting shipment must email garett@empireauctionco.com and include:

  • Full name
  • Invoice number
  • Shipping address for eligible non-firearm items
  • A signed copy of the receiving dealer's FFL for firearms requiring shipment to an FFL

Applicable shipping and handling charges will then be added and a finalized invoice will be issued.

Online payment of the finalized invoice must be completed within 48 hours of receipt, unless prior arrangements have been approved.

Firearm Shipping & Handling

  • Handguns: $25 per firearm
  • Long guns: $40 per firearm
  • Firearms requiring shipment will be shipped to a valid Federal Firearms License (FFL) holder as required by law.
  • Any transfer or other fee charged by the buyer's receiving FFL is the buyer's responsibility and is separate from fees charged by Empire Auction Co. LLC.

Ammunition Shipping & Handling

  • $15 per lot up to 15 lbs.
  • Multiple ammunition lots may be combined for shipping when practical.
  • Lots, or combined groups of lots, exceeding 15 lbs. will be billed at actual carrier cost.
  • Ammunition must ship separately from firearms.
  • Ammunition will only be shipped to jurisdictions where shipment and possession are lawful.
  • Buyers are responsible for ensuring they may legally receive and possess the ammunition purchased under all applicable federal, state, and local laws.
  • Empire Auction Co. LLC reserves the right to refuse shipment where applicable legal requirements cannot be satisfied.

Other Items

  • Oversized items eligible for shipment will be billed at actual freight or carrier cost. Freight shipping can be expensive; please bid accordingly.
  • Empire Auction Co. LLC reserves the right to determine the appropriate carrier, service level, packaging, signature requirements, and other reasonable shipping requirements.
  • Empire Auction Co. LLC is not responsible for carrier delays or circumstances beyond its control but will reasonably assist buyers with carrier claims when appropriate.

Auction Pickup Dates

September 16–20

Pickup is available during Highland Arms LLC's regular business hours:

  • Tuesday–Friday: 9:00 AM–5:00 PM
  • Saturday–Sunday: 9:00 AM–3:00 PM
  • Monday: Closed

No appointment is required.

Buyers should be prepared for possible wait times during busy pickup periods, particularly when picking up firearms requiring transfer paperwork.

UNCLAIMED ITEMS & STORAGE

  • Buyers are expected to pick up their purchases during the designated September 16–20 pickup period, unless prior arrangements have been approved by Empire Auction Co. LLC.
  • Buyers will receive an additional 10-calendar-day grace period following September 20 before storage fees may begin.
  • Items remaining after the grace period may be subject to reasonable storage and handling fees.
  • Buyers who are unable to retrieve their items within the designated period are encouraged to contact Empire Auction Co. LLC as soon as possible to make arrangements.
  • Property remaining unclaimed for an extended period may, after reasonable attempts to contact the buyer and as permitted by applicable law, be moved, stored, or resold by Empire Auction Co. LLC.
  • Reasonable storage, handling, resale commissions, and other costs incurred in connection with unclaimed property may be deducted from any resale proceeds. Any remaining proceeds will be handled in accordance with applicable law.

FIREARMS

All firearm transfers handled locally will be completed through Highland Arms LLC, a federally licensed firearms dealer (FFL).

  • All firearms are subject to the $10 firearm transfer fee included on the Empire Auction Co. invoice.
  • All applicable federal, state, and local firearm laws apply.
  • A completed ATF Form 4473 is required for applicable firearm transfers completed through Highland Arms LLC.
  • A National Instant Criminal Background Check System (NICS) background check will be conducted when required by law.
  • Buyers requesting shipment must have firearms shipped to a federally licensed firearms dealer (FFL) when required by law.
  • Buyers requesting firearm shipment must email a signed copy of their receiving dealer's FFL to garett@empireauctionco.com and include their full name and invoice number.
  • Buyers are solely responsible for ensuring they meet all applicable federal, state, and local age, eligibility, ownership, possession, and transfer requirements for the firearm purchased.
  • A buyer's inability to legally receive a firearm does not automatically cancel the sale.
  • If a firearm transfer cannot legally be completed, Empire Auction Co. LLC may, at its discretion and as permitted by law, cancel the transfer, arrange for lawful transfer to another eligible FFL or purchaser where appropriate, or resell the firearm.
  • Any reasonable commissions, fees, shipping, storage, or other expenses incurred as a result of an unsuccessful or prohibited transfer may be deducted from amounts otherwise due to the purchaser.
  • Empire Auction Co. LLC reserves the right to refuse or cancel any firearm transfer that cannot legally be completed.

ITEM CONDITION & DESCRIPTIONS

Every reasonable effort has been made to accurately photograph and describe each item.

ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS, AND WITHOUT ANY WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED.

Descriptions, photographs, measurements, manufacturer information, and condition statements represent the opinion of Empire Auction Co. LLC and are provided as a guide. Variations in lighting, photography, monitor settings, manufacturer specifications, normal wear, or other factors may affect appearance.

Bidders are encouraged to carefully review all photographs and descriptions before placing a bid.

If you believe an item has been materially misrepresented, you must notify Empire Auction Co. LLC within three (3) business days of pickup or delivery.

A material misrepresentation is a significant error in the listing that would have reasonably affected a bidder's decision to bid or the amount they were willing to bid.

Empire Auction Co. LLC stands behind its descriptions and will work in good faith to resolve legitimate listing errors.

This policy does not apply to:

  • Buyer's remorse
  • Differences of opinion regarding cosmetic condition
  • Normal wear
  • Conditions visible in the photographs
  • Conditions disclosed in the listing

DEFAULT

Failure to pay for purchased items constitutes a breach of these Auction Terms & Conditions.

Empire Auction Co. LLC reserves the right, as appropriate, to:

  • Charge the payment method on file.
  • Cancel the sale.
  • Revoke current and future bidding privileges.
  • Resell the item or items.
  • Recover reasonable commissions, fees, storage, shipping, handling, or other losses resulting from the default.
  • Pursue any other remedies available under applicable law.

ADDITIONAL TERMS

  • Empire Auction Co. LLC reserves the right to correct catalog errors, modify descriptions, withdraw lots, postpone closing, or cancel sales when reasonably necessary.
  • Empire Auction Co. LLC is not responsible for internet interruptions, software failures, power outages, or technical issues experienced by bidders.
  • By participating in this auction, bidders consent to receive necessary auction-related communications including invoices, payment reminders, shipping information, and pickup notifications.
  • Bidders may also receive promotional communications from Empire Auction Co. LLC and may unsubscribe from promotional communications at any time.
  • These Auction Terms & Conditions shall be governed by the laws of the State of Iowa.
